澄清函 Clarification Letter

     Aquafine Corporation为美国丹纳赫集团旗下先进的紫外线设备制造商，是注册商标“AQUAFINE”（中国商标注册号：1006269）在第11类商品上的合法持有人，该注册商标的有效期至2027年5月13日；哈希水质分析仪器（上海）有限公司（“哈希中国”），系美国丹纳赫集团在华设立的全资子公司，亦为Aquafine Corporation的关联公司，在中国境内全权负责丹纳赫水平台包括Aquafine产品的进口、销售及经销渠道管理业务（以下合称“我方”）。   
    Aquafine Corporation is a leading ultraviolet equipment manufacturer of Danaher Group and the lawful owner of the registered trademark “AQUAFINE” in Class 11 in China (Chinese Registration No: 1006269), which is valid until May 13, 2027. Hach Water Analytical Instrument (Shanghai) Co., Ltd. (“Hach China”) is a subsidiary wholly invested by Danaher Group in China and an affiliated company of Aquafine Corporation. Hach China is fully authorized to import and sell the products of Danaher Water Quality Platform (including Aquafine’s products) as well as to manage the distribution channels thereof within the territory of China.

    我方现获悉上海环琪环保科技有限公司（以下简称“上海环琪”）向我方客户销售假冒Aquafine Corporation产品并伪造相关文书一事，特向我公司客户及公众告知如下：            
    As learned that Shanghai Huanqi Environmental Protection Technology Co., Ltd. (hereinafter referred to as “Shanghai Huanqi”) sold counterfeited Aquafine Corporation’s products to our customers and forged official documentation relating to our products, we hereby clarify to our customers and the public as follows:

• 上海环琪与我公司、美国Aquafine Corporation及丹纳赫集团任何其他运营公司即无关联关系，也无合作关系。Aquafine Corporation从未指定过上海环琪代表我方在中国成立驻华办事处或代表处，亦未以任何形式授权过上海环琪销售、经销或分销Aquafine的产品。上海环琪宣称自己为Aquafine驻华办事处及全国总代理的言论均为虚假表述。
  Shanghai Huanqi does not have any affiliation relationship or cooperation relationship with our company, Aquafine Corporation or any other operation company of Danaher Group. Aquafine Corporation has never designated Shanghai Huanqi to present us to establish any representative office in China or authorized Shanghai Huanqi in any way to sell, distribute or resell Aquafine’s products. The promotion statement made by Shanghai Huanqi that Shanghai Huanqi is Aquafine’s China representative office and China general agency, is false statement.
• 经我方鉴定，上海环琪向我公司客户销售的标有“Aquafine”商标的产品均为仿造的假货。该等产品并非由我方生产及出售，其来源及品质都无法得到有效的保证。
  Upon our verification, the products attached with the trademark “Aquafine” sold by Shanghai Huanqi to our customers are all counterfeited products. These products were not produced or sold by us. The source and the quality of such products cannot be effectively guaranteed.
• 上海环琪向客户发送的标题为“UV AQUAFINE Statement”的产品召回书系其自行伪造。我方所生产和销售的产品从未发生过因质量问题被召回的情况，我方也从未以任何形式向客户发出过上述产品召回书。
  The recall statement named “UV AQUAFINE Statement” sent by Shanghai Huanqi to our customers was forged by Shanghai Huanqi itself. The products manufactured and sold by us have never been recalled due to quality defects and we never sent the aforementioned recall statement to customers in any form.
  
  

     我方将全面保留追究上海环琪未经授权仿造我方文件并销售标注我方商标的伪造产品的一切权利。            
     We reserve full rights to take any legal actions necessary against Shanghai Huanqi for its forging our official documentation and selling counterfeits attached with our registered trademark.
